Terms of service
These General Terms and Conditions apply to all offers, orders, and agreements of PreLoved Pieces.
Article 1 – Definitions
1.1 PreLoved Pieces: the user of these general terms and conditions and the entrepreneur offering preloved and vintage designer items and related services.
1.2 Customer: any natural person acting as a consumer, or any legal entity, entering into an agreement with PreLoved Pieces.
1.3 Agreement: any agreement between PreLoved Pieces and the Customer regarding the purchase of goods or services.
1.4 Preloved item: a second-hand designer item that has been previously used and may therefore show signs of wear.
1.5 Cooling-off period: the period of 14 calendar days within which the consumer can exercise their right of withdrawal for an online purchase.
1.6 Right of withdrawal: the possibility for the consumer to dissolve the distance agreement within the cooling-off period.
1.7 Security Tag: the seal applied by PreLoved Pieces that serves as proof of the item's condition and authenticity upon delivery.
1.8 Entrupy: the external authentication technology used to verify the authenticity of items.
1.9 Showroom: the physical location of PreLoved Pieces in Breda where purchases take place exclusively by appointment.

Article 3 – Applicability
3.1 These general terms and conditions apply to every offer made by PreLoved Pieces and to every agreement reached. 3.2 Before the agreement is concluded, the text of these general terms and conditions will be made available to the Customer electronically.
Article 4 – The Offer and Preloved Status
4.1 The offer contains as complete and accurate a description as possible of the products offered.
4.2 All items offered are preloved or vintage. The Customer is aware that these items may show signs of wear consistent with age, use, and the described condition.
4.3 Signs of wear corresponding to the stated condition do not constitute a defect. The purchase is made taking into account the preloved status, without prejudice to the consumer's statutory rights.
4.4 Images are intended as a truthful representation. Minor deviations in color or detail may occur due to screen settings.
Article 5 – Conclusion of the Agreement and Payment
5.1 The agreement is concluded at the moment the Customer accepts the offer and complies with the conditions set.
5.2 The Customer is responsible for correctly entering personal data and the delivery address. Consequences of incorrect data are at the expense of the Customer.
Article 6 – Authenticity and Entrupy
6.1 PreLoved Pieces guarantees the authenticity of every item sold.
6.2 Entrupy technology is used for verification. Certificates are exclusively generated for items confirmed as authentic.
6.3 A certificate is only valid for the specific item for which it was issued and may not be used for other products.
6.4 Incorrect or misleading use of certificates will result in the voiding of the Entrupy guarantee.
Article 7 – Right of Withdrawal and Security Tag
7.1 For online purchases, the consumer has a 14-day cooling-off period after receiving the product.
7.2 Each item is delivered with a unique Security Tag. During the cooling-off period, the Customer may only inspect the item as is customary in a physical store, provided the Security Tag remains fully intact.
7.3 If the Security Tag has been removed, broken, or damaged, PreLoved Pieces reserves the right to refuse the return or charge a reduction in value, as the item is no longer in its original condition and cannot be resold.
7.4 Purchases made physically in the showroom are excluded from the right of withdrawal. These sales are final.

8.1 Withdrawal and return notification
The Customer may exercise the right of withdrawal within 14 days after receiving the item by notifying PreLoved Pieces via the withdrawal button in the customer account or by email at returns@shoprelovedpieces.com.
8.2 Return period
After notifying the withdrawal, the item must be returned to PreLoved Pieces within 14 days.
8.3 Condition of the item
The item must be returned in the same condition as received and may not be used beyond what is necessary to assess the nature, characteristics and authenticity of the item.
8.4 Complete return
The item must be returned complete and in full, including all supplied accessories and components, including dust bags, authenticity documents, straps, locks, keys, boxes and other accessories, where applicable.
8.5 Security tag
The item is fitted with the PreLoved Pieces security tag, which must remain fully intact. If the tag has been removed, broken, or damaged, we unfortunately cannot accept the return.
8.6 Shipping method and risk of return shipment
Return shipments are entirely at the Customer’s expense and risk. Returns must be shipped fully insured, traceable and with signature upon delivery. The risk of loss, theft or damage during return shipment remains fully with the Customer until the item has been received by PreLoved Pieces.
8.7 Inspection of returns
Upon receipt, PreLoved Pieces will inspect the returned item for authenticity, condition, completeness and any signs of use.
8.8 Refund
After receipt and inspection of the returned item, PreLoved Pieces will refund the amount due using the same payment method used for the original transaction, unless agreed otherwise. PreLoved Pieces may withhold reimbursement until the returned item has been received or until the Customer has provided convincing proof of return shipment.
Article 9 – Maintenance and Use
9.1 Maintenance advice is provided solely as a general guideline.
9.2 PreLoved Pieces is not liable for damage caused by improper use, cleaning, or treatment by the Customer or third parties.
Article 10 – Conformity and Statutory Warranty
10.1 PreLoved Pieces warrants that the products comply with the agreement, taking into account the preloved status.
10.2 Signs of wear that fall within the described condition do not constitute a deficiency.
10.3 The statutory warranty applies to all products.
Article 11 – Prices and Delivery
11.1 All prices are stated in Euros.
11.2 Shipping costs will be clearly communicated before the conclusion of the agreement.
11.3 PreLoved Pieces will execute orders with due speed and at the latest within 30 days, unless otherwise agreed.
11.4 VAT is levied on second-hand goods in accordance with applicable legislation. Where applicable, the margin scheme is applied. Any import duties are the responsibility of the Customer.
11.5 Any import duties, customs charges, taxes and other additional costs arising from international shipments or import into the country of destination are entirely the responsibility of the Customer. If a shipment is refused or not accepted due to unpaid import duties, customs charges or taxes, all resulting costs, including return shipping costs and any additional charges imposed by the carrier or customs authorities, shall also be fully borne by the Customer.
Article 12 – Liability
12.1 PreLoved Pieces is not liable for indirect damage, consequential damage, or lost profits.
12.2 The liability of PreLoved Pieces is at all times limited to the amount of the purchase price of the product concerned, unless there is intent or gross negligence.
Article 13 – Force Majeure
13.1 PreLoved Pieces is not obliged to fulfill any obligation if it is prevented from doing so by force majeure, which includes delays at carriers, customs inspections, malfunctions, or government measures.
Article 14 – Complaints
14.1 Complaints about the execution of the agreement must be submitted fully and clearly described via info@shopprelovedpieces.com within a reasonable time after discovery.
Article 15 – Privacy
15.1 Personal data are processed in accordance with applicable privacy legislation. Please refer to the privacy statement on the PreLoved Pieces website for more information.
Article 16 – Applicable Law and Disputes
16.1 All agreements between PreLoved Pieces and the Customer are exclusively governed by Dutch law.
16.2 Disputes will be submitted to the competent court in the district where PreLoved Pieces is established.
Article 17 – Written Deviations
17.1 Deviations from these general terms and conditions are only valid if confirmed in writing by PreLoved Pieces.
17.2 Any deviations shall not affect the validity of the remaining provisions of these terms and conditions.
Article 18 – Retention of Title
18.1 All delivered products remain the property of PreLoved Pieces until the Customer has fully fulfilled all payment obligations arising from the agreement.
18.2 As long as ownership has not transferred, the Customer is not permitted to alienate, pledge, or otherwise encumber the products.
Article 19 – Intellectual Property Rights
19.1 All intellectual property rights regarding the website, product descriptions, photography, texts, and other materials rest with PreLoved Pieces or its licensors.
19.2 Without prior written permission from PreLoved Pieces, it is not permitted to copy, disclose, or otherwise use these materials.
Article 20 – Payment and Payment Methods
20.1 Payment must be made in full before delivery of the product.
20.2 PreLoved Pieces only accepts the payment methods offered via the website.
20.3 If a payment is not made or not made on time, PreLoved Pieces reserves the right to suspend or dissolve the agreement.
